Bad checks (Worthless Check)

Under the statute, it is illegal to write a check or use your debit card when you know you do not have enough in the bank to cover the check or amount withdrawn on the debit card. This statute does not apply to “payday advances.”
If the value of the check or debit card withdrawal is $150 or less, it is a first degree misdemeanor punishable by up to one year in jail. If fit is $150 or more it is a third degree felony punishable by up to five years in jail.

There are defenses to a bad check charge, and there are usually alternatives to jail. This is especially true if you have reported a check book or a debit card lost or stolen, or if you recently closed an account due to computer hacking.
