Possession of Child Pornography

If you have been accused in the Orlando area of possessing child pornography in violation of Florida Statute 827.071(5)(a), the law office of Finebloom & Haenel can provide a compassionate and competent defense to you!

Under the statute, it is unlawful for any person to knowingly possess, control, or intentionally view a photograph, motion picture, exhibition, show, representation, image, data, computer depiction, or other presentation which, in whole or in part, he or she knows to include any sexual conduct by a child. A person who violates this subsection commits a felony of the third degree, punishable by up to five years in a Florida State prison and a $5000 fine.

The possession, control, or intentional viewing of each such photograph, motion picture, exhibition, show, image, data, computer depiction, representation, or presentation is a separate offense. This means if you have two photographs, your maximum time in prison could be 10 years. If you have three it could be fifteen years and so on.  Ignorance of the child’s age is not a defense!!

Florida takes a strong stance against crimes involving sex and children. Many judges will find ways to rule outside the law in order to make sure the accused goes to prison. Prison inmates usually shun other inmates with charges of this type and sometimes physically harm them. After a conviction you not only have the stigma of being a convicted felon, but you will have to register and you could possibly be subject to civil commitment under the Jimmy Ryce Act.

A bond for this type of charge is usually very high. In addition the Court will probably restrict your activities upon release. While awaiting the outcome of your case it is very likely the Court will restrict you from accessing a computer or being around children without supervision, if at all.
