Cocaine Trafficking

Under Florida Statute 893.135(1)(b)if you are arrested with 28 grams or more of cocaine you will be charged with trafficking. This applies even if you have bought this amount for personal use! If you have been arrested in the Orlando area with over 28 grams of cocaine, you need to speak with the aggressive defense attorneys of Finebloom & Haenel immediately!!

Trafficking cases are becoming more and more common. The State is becoming less tolerant of drug use and is using the law to charge offenders with crimes that carry minimum mandatory sentences instead of normal possession charges. If you are convicted of cocaine trafficking, you can face the following penalties:

  • If you are convicted of having between 28 grams and 200 grams of cocaine, it is a mandatory 3 year prison sentence and $50,000 fine.
  • If you are convicted of having between 200 grams and 400 grams of cocaine, it is a mandatory 7 year prison sentence and a $100,000 fine.
  • If you are convicted of having more than 400 grams of cocaine but less than 150 kilograms, you must serve at least 15 years in prison and pay a $250,000 fine.
  • If you are convicted of having over 150 kilograms you will be sentenced to life in prison with no possibility of parole or discretionary release.

As you can see, a trafficking charge is a very serious matter carrying severe penalties. Mandatory minimum sentences are served day for day with non possibility of gain time or early release. In addition to the heavy fines, license suspension and criminal registration requirements, a conviction can also keep you from obtaining housing, student loans and professional licenses.
