Cultivation

If you have been arrested in the Orlando area for a violation of section 893.13 or 893.147(2) of the Florida Statutes that prohibits the cultivation of marijuana you will need an experienced team of defense attorneys who are experienced in defending drug crimes. Cultivation of marijuana is a 3rd degree felony punishable by up to 5 years in a Florida state prison. Florida statute 893.02(5) says that “Cultivating” means the preparation of any soil or hydroponic medium for the planting of a controlled substance or the tending and care or harvesting of a controlled substance. In plain English, “cultivating” means growing marijuana or doing any activity that helps to grow marijuana.

If you have enough plants, the State may choose to charge you with trafficking instead of cultivation. This can lead to minimum mandatory sentences and extraordinary fines.
