Fleeing to Elude and Aggravated Fleeing to Elude

If you have been arrested in the Orlando area of Fleeing to Elude or Aggravated Fleeing to Elude in violation of Florida Statue 316.1935, call the law office of Finebloom & Haenel now at 407-218-6277 to discuss your defense options.

To prove fleeing to elude the State must show that you willfully fled or attempted to elude a police officer in a marked patrol car with its lights and siren activated. Fleeing to elude is a third degree felony punishable by up to five years in prison.

If while fleeing or attempting to elude the police you speed or drive in a manner that shows wanton disregard for safety of people or property it is a second degree felony punishable by up to 15 years in the Florida Department of Corrections.

If while fleeing or attempting to elude the officer you not only speed or drive in a manner that shows wanton disregard for the safety of people or property and you cause serious bodily injury or death it is a first degree felony punishable by up to 30 years in prison. In addition there is a 3 year minimum mandatory sentence that must be served!!

Aggravated fleeing to elude occurs when in addition to trying to flee or elude the police, you also leave or attempt to leave the scene of an accident and you willfully ignore an officers command to stop. If while fleeing or eluding you cause damage to property or injury to another person, it is a second degree felony punishable by up to 15 years in prison. If you cause serious bodily injury or death while attempting to flee or elude the officer when there is an accident involved, it is a first degree felony punishable by up to 30 years in prison. In addition there is a mandatory 3 year sentence that must be served!

Whether you are convicted of Fleeing to Elude or Aggravated Fleeing to Elude you will lose your license for a period of 5 years!!
