Incest

Florida Statute 826.04 makes it illegal to knowingly marry or have sexual intercourse with a close family member. These close family members are known as “people related by lineal consanguinity.” In layman’s terms, those relations include a grandparent, mother, father, brother, sister, uncle, aunt, nephew, or niece.

Violation of this statute is a felony of the third degree, punishable by up to 5 years in a Florida State Prison.  “Sexual intercourse” as defined in this statute is “the penetration of the female sex organ by the male sex organ, however slight. . . ” This means you do not have to ejaculate for the State to prove sexual intercourse.
It is a defense to this statute if you do not know you are related. In these changing times where men father several children by several mothers, it is possible to not know you are related until it is too late.
