Lewd or Lascivious Act

If you have been arrested in the Orlando for an unnatural and lascivious act in violation of Florida Statute 800.02, the attorneys of Finebloom & Haenel are available and willing to assist you.

According to Florida law, a person who commits any unnatural and lascivious act with another person commits a misdemeanor of the second degree, punishable by up to 60 days in the county jail. Lewd and lascivious acts are generally recognized as those that give some type of sexual gratification. Some types of activities that qualify as lewd or lascivious under the statute include the following:

  • masturbation;
  • Intentionally exposing the genitals in a lewd or lascivious manner (this charge does not apply to public urination);
  • Intentionally committing any other sexual act that does not involve actual physical or sexual contact with the victim, such as sexual bestiality, or the simulation of any act involving sexual activity or having sex in public.

Many times visitors down on spring break or other fun vacations get arrested for this crime when they are caught “flashing” another individual in public. Arrests can also occur when couples become a little too intimate in a public place.
