Lewd or Lascivious Molestation (Fondling)

Florida statute 800.04(5) defines the charge of lewd and lascivious molestation as touching the genitals of a person under the age of 16 or having a person under the age of 16 touch your genitals. If you have been arrested in the Orlando area for a violation of this statute, you will need competent, experienced representation.  The attorneys of Finebloom & Haenel can provide that representation.

The penalties for lewd and lascivious molestation are severe.

  • If you are over 18 and the child is under 12, lewd and lascivious molestation is punishable by life in prison. This means you would have to serve no less than 30 years upon conviction.
  • If you are under the age of 18 and the child is under 12, lewd and lascivious molestation is a second degree misdemeanor punishable by up to 15 years in prison.
  • If you are over the age of 18 and the child is between 12 and 16 years of age, lewd and lascivious molestation is a second degree felony punishable by up to 15 years in prison.
  • If you are under 18 and the child is between 12 and 16 years of age, lewd and lascivious molestation is a third degree felony punishable by up to five years in prison.

Whether you are convicted of sexual battery or lewd and lascivious molestation, you will be labeled a sex offender and be forced to register for the rest of your life!!! In addition you will be labeled a convicted felon and lose your right to vote and carry a firearm. You will also be subject to civil commitment proceedings under the Jimmy Ryce Act. You may lose your professional license and may be evicted form certain types of housing.
