Possession with Intent to Deliver/Sell/Distribute-Opiates

Under the Florida statue,“distribute” means to deliver. “Deliver” or “delivery” means the actual, constructive, or attempted transfer from one person to another of a controlled substance. Possession with intent to sell, deliver or distribute is a second degree felony punishable by up to 15 years in the Florida Department of Corrections and a $10,000 fine.

If the possession occurred within 100 feet of a church, park or school, the crime is enhanced to a 1st degree felony punishable by up to 30 years in the Florida Department of Corrections!!
