Luring or Enticing a Child

  • Under the law any person 18 years of age or older who intentionally lures or entices, or attempts to lure or entice, a child under the age of 12 into a structure, dwelling, or conveyance for other than a lawful purpose commits a misdemeanor of the first degree, punishable by up to one year in the county jail. The purpose does not have to be sexual. It can be for any reason not allowed by the law.
  • If you have been previously convicted of luring or enticing a child, and are charged again, the penalty is increased. A second offense is a third degree felony punishable by up to five years in a state prison.
  • If you are charged with this crime, and you have previously been convicted of either a sex crime, a crime involving lewd and lascivious acts or a crime involving obscenity, and you intentionally lure or entice, or attempt to lure or entice, a child under the age of 12 into a structure, dwelling, or conveyance for other than a lawful purpose it is a felony of the third degree, punishable by up to five years in prison, even if this is your first time being charged with this crime.

Defenses to this charge include the fact that you were trying to protect a child from harm or a dangerous situation or that you were not trying to lure the child in for an unlawful purpose. For instance, if you are trying to get a two year old to come inside because he is unsupervised and playing in the road, you may have a defense.
