Technicial Violation of Probation

  • Technical Violation

If you have been arrested in the Orlando area for a technical violation of probation under Florida statute 948.06, the attorneys of Finebloom & Haenel can help you.
A technical violation of probation is any violation of your probation that does not involve you committing a new crime. A “technical violation” of probation occurs when you don’t meet a requirement of your probation or when you can’t complete one of the terms of your probation on time. The most common technical violations are:

  • failing to pay court costs;
  • failing to pay cost of supervision;
  • failing to pay restitution;
  • failing a drug test; and
  • failing to report to your probation officer.

Technical violations are still violations. You can still be convicted and sentenced even though you did not break the law. If you are found to have violated your probation, you can be given any sentence that you faced when you were originally sentenced. In addition, a violation of probation adds points to your scoresheet. This can mean the difference between reinstatement and prison time!
