Lewd or Lascivious Battery

Florida Statute 800.04 covers Lewd and Lascivious offenses committed upon or in the presence of a person 16 years of age or younger. If you have been arrested in the Orlando area for a violation of this statute, the experienced team of lawyers at Finebloom & Haenel are ready to represent you!

Under Florida Statute 800.04(4) if you have consensual sex with a person under the age of 16 it is considered to be a lewd and lascivious Battery. It is not a defense that you thought the person was over the age of 16 or that they consented!! Lewd and lascivious battery is a second degree felony punishable by up to 15 years in prison.

Even if you do not have sex with a person between the age of 12 and 16, you can still be prosecuted under this statute if you encourage a person between the age of 12 and 16 to engage in other forms of sexual activity such as prostitution.

Any type of sex crime subjects you to social stigma and loss of liberty. You can also be subject to criminal registration for the rest of your life. This is especially true when the act involves children or the term “battery.” Do not take any chances with your life and reputation. Contact the experienced defense team at Finebloom & Haenel. Our attorneys are available 24/7 to discuss your case with you. We will provide you with aggressive and competent representation. Do not wait! Call us now!
