Violation of restraining orders (domestic injunction)

In injunction or restraining order is a command by the court. If an injunction has been entered against you, you either are limited in your contact with another person, or prohibited from having contact with that person. It is an official court order for you to do something or refrain from doing something.

Many times the person who petitioned the Court to have the injunction put in place will tell you that they want to have contact with you or that they have asked to have the injunction changed or dropped. UNTIL YOU GET AN ORDER FROM THE COURT THAT SAYS IT IS MODIFIED OR DROPPED ALL TERMS ARE IN PLACE!!  This means, if the person who asked for the injunction invites you over and you go, you can be arrested for violating the order of the court. If the person calls you and you answer the phone, you can be arrested for violating the injunction. HAVING THE OTHER PERSON SAY IT’S OK TO TALK WITH THEM IS NOT A DEFENSE TO VIOLATION OF AN INJUNCTION!

If the State convicts you of violating an injunction you will be required to attend classes through the Certified Batterer’s Intervention Program or “CBIP.” CBIP is 29 weeks of anger management classes provided in a group setting by a licensed clinical social worker. If convicted, you would be required to attend these classes once a week for 29 weeks. You must pay each week for the class. Failing to attend the class can result in a violation of probation charge or a contempt charge from the court. This is in addition to any jail time or other sanctions imposed by the court. Domestic cases are first degree misdemeanors punishable by up to one year in the county jail.
