The Orlando office of Finebloom and Haenel is made up of attorneys dedicated to competent, rigorous DUI defense.  Over the course our lawyers’ experiences with DUI cases in Orlando and the surrounding central Florida regions, we’ve answered thousands of questions.  Among the most common questions, one has an answer that most drivers find startling and do not expect.

“In the state of Florida, how long does a DUI conviction stay on my record?”

The answer: 75 years.

The Florida Department of Highway Safety and Motor Vehicles (HSMV) maintains a complete record system of driving records.  As technology advances and allows different states to work together, more and more states begin sharing electronic records.  If a Florida driver is convicted of DUI and then moves to Georgia 2 years later, Georgia’s DMV will still have the ability to run a driving record check and note the offense

The HSMV mandates that less sever convictions resulting in point assessments stay on a driver’s record for 10 years.  However, more serious offenses (which include DUI and vehicular manslaughter) remain on record for 75 years.

In most cases, the sting of a DUI conviction will be accessible in DMV records for the rest of your life.  The only saving grace may constitute a “look-back” period policy instituted by other states or insurance policies.  If a driver moves out of state and that state’s DMV only checks back a few years, or if a new insurance policy only checks back a prescribed amount of years, an old DUI may not be detected.  However, any DMV record check that goes back far enough, up to 75 years, can detect a DUI in Florida.
