Finebloom and Haenel – Orlando’s DUI Defense Lawyers

When Orlando authorities make a traffic stop, they will undoubtedly be watching for signs of impairment when they interact with the driver.  If a driver has been drinking or is impaired by any other substance, certain signs will be detectable by a police officer.   The DUI Defense attorneys at Finebloom and Haenel know DUI law and prosecution processes in Orlando and throughout the state of Florida.

Based on our past cases and experience defending DUI cases in Orlando, basic signs that a driver is intoxicated can include:

  1. Vehicle Drifting or Floating within a Lane:  If police observe a driver swerving, or even drifting slightly within their own lane, they will suspect DUI.  Subtle driving patterns differ substantially between a regular driver and a driver who is impaired.  “Floating” back and forth between (but not crossing over) the lines of a driver’s own lane is a common “tell” of minor impairment. This often occurs without the impaired driver actually recognizing that it is happening.   When a driver fully crosses the broken lines and partially drifts into adjacent lanes, police will suspect that the level of impairment is significant and is almost always substantially above the legal BAC  limit.
  2. Appearance of Eyes/Face – Once an officer gets a look at the driver, he/she may observe physical signs of intoxication “written on the driver’s face”.  Glassy eyes, a red nose, or even a flushed facial complexion can indication intoxication. An intoxicated driver’s eyes may also tend to drift or look “tired”.  The intoxicated person’s eyes may appear droopy and their ability to focus in on certain points can be delayed.
  3. Attempts to Mask the Smell of Alcohol:  When someone is intoxicated, alcohol is in their blood. Hours after having too much to drink, alcohol is being expelled through a person’s skin and, more noticeably, through their breath when they exhale.  Spraying perfume or chewing gum does not work. Police can decipher the scent of brand new mints or a fragrance that has just been sprayed within seconds of being pulled over.  This draws immediate suspicion of intoxication; as such actions typically occur as an attempt to cover up something that the driver does not want the police to find out about.
